Tradie Health Month Giveaway Terms & Conditions

1. Promoter

• The promoter is earth gear (ABN 37 640 190 290), based in Narangba, Queensland, Australia.
• All references to “earth gear”, “we”, “us” or “our” in these Terms & Conditions refer to the promoter.

2. Eligibility

• Entry is open to Australian residents aged 18 years and over.
• Employees of earth gear and their immediate families, and any agencies or companies associated with the promotion, are ineligible to enter.
• By entering, you confirm that you meet the eligibility criteria and agree to these Terms & Conditions.

3. Promotion Period

• The promotion runs from 12:00am AEST 1 August to 11:59pm AEST 31 August (Promotion Period).
• Donations received outside the Promotion Period are not eligible for entry into the giveaway.

4. How to Enter

• To enter, an eligible person must make a monetary donation to Beyond Blue through earth gear’s fundraising page (https://fundraise.beyondblue.org.au/earth-gear)during the Promotion Period.
• Each eligible person will receive one (1) entry into the draw, regardless of the number or total value of donations made.
• Entries are automatic based on donation records; no separate entry form is required.
• Incomplete, illegible or fraudulent donations/entries may be deemed invalid at earth gear’s sole discretion.

5. Prize

• There is one (1) prize to be won: a 50L Dune 4WD Single Zone Fridge/Freezer valued at $299 (RRP).
• The prize value is correct at the time of publishing; earth gear is not responsible for any subsequent price changes.
• The prize is not transferable, exchangeable or redeemable for cash or any other products or services.
• If the prize (or part of the prize) is unavailable for any reason, earth gear reserves the right to substitute the prize with a similar product of equal or greater value.

6. Winner Selection

• One (1) winner will be chosen at random from all eligible entries.
• The random draw will be conducted by earth gear (or its appointed representative) within 7 days of the Promotion Period ending.
• earth gear’s decision regarding the draw and all aspects of the promotion is final and no correspondence will be entered into.

7. Winner Notification & Prize Delivery

• The winner will be notified via the contact details associated with their donation (e.g., email or phone).
• If the winner cannot be contacted within 7 days of the draw, or does not respond within 7 days of notification, earth gear reserves the right to conduct a redraw and select a new winner.
• The prize will be delivered to the winner by post or courier to an Australian address, or collected from an agreed location, as arranged directly with the winner.
• earth gear is not responsible for any loss, damage or delay in prize delivery once dispatched.

8. Privacy

• earth gear will collect and use personal information provided during the donation and entry process to administer the promotion and contact the winner.
• Personal information will be handled in accordance with earth gear’s Privacy Policy, available on our website.
• By entering, you consent to earth gear using your name, suburb, and/or photograph for reasonable promotional purposes (including social media and website announcements) without additional compensation, where lawful.

9. Social Media Disclaimer

• This promotion is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Instagram or Facebook.
• By participating, you release Instagram and Facebook from any liability arising from or in connection with the promotion.
• Any information you provide is to earth gear and not to Instagram or Facebook.

10. General Conditions

• earth gear reserves the right to verify the validity of entries and the identity of entrants.
• earth gear may, in its sole discretion, disqualify any entrant who tampers with the entry process, submits an entry not in accordance with these Terms & Conditions, or engages in any conduct that may be detrimental to the promotion.
• If the promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated (including due to technical problems, fraud, or causes beyond earth gear’s control), earth gear reserves the right, in its sole discretion, to modify, suspend, terminate or cancel the promotion.
• To the maximum extent permitted by law, earth gear is not liable for any loss, damage or injury suffered or sustained (including but not limited to direct or consequential loss) as a result of entering the promotion, winning the prize or using the prize.
• These Terms & Conditions are governed by the laws of Queensland, Australia, and participants submit to the non-exclusive jurisdiction of the courts of that state.
