Put the Fleet to Work Terms and Conditions

Promoter: earth gear Pty Ltd (ABN 37 640 190 290) (“earth gear”, “we”, “us”, “our”)
Campaign period: 20 July 2026 – 30 August 2026 (the “Campaign Period”)

These Terms & Conditions (“Terms”) govern the “Put the Fleet to Work” promotional campaign. By taking up any offer under this campaign, you (“you”, “the Hirer”) agree to these Terms. These Terms are additional to, and should be read together with, earth gear’s standard Equipment Hire Agreement / Hire Terms and Privacy Policy. If there is any inconsistency, these Terms prevail to the extent of the promotional offer only; the standard Hire Agreement governs the hire in all other respects.

1. The Campaign

1.1 The “Put the Fleet to Work” campaign runs for a six (6) week period during the Campaign Period.

1.2 Promotional offers are released on a weekly basis and may change from week to week. The specific machines, categories, rates and offers available in any given week are at earth gear’s sole discretion and are subject to fleet availability.

1.3 earth gear reserves the right to vary, suspend, extend or withdraw any offer (or the campaign as a whole) at any time without notice, including where a machine or category is no longer available for hire. Any variation will not affect a hire already confirmed under a valid booking.

1.4 All offers are available while suitable equipment remains available. Offers are subject to a machine of the relevant type being available at the servicing branch for the requested dates.

2. Free Delivery Offer

2.1 During the Campaign Period, earth gear is offering free delivery on eligible hires to sites located within 60 kilometres of an earth gear branch (the “Free Delivery Offer”).

2.2 The 60km radius is measured by road distance from the nearest participating earth gear branch to the delivery address, as determined by earth gear.

2.3 The Free Delivery Offer:

• (a) applies to one (1) standard delivery of the hired equipment to the nominated site;
• (b) covers standard delivery only and excludes return collection/pick-up, re-deliveries, relocation of equipment between sites, and delivery to sites requiring specialised transport or access equipment, unless otherwise agreed in writing;
• (c) is available only for eligible equipment nominated by earth gear during the relevant offer week; and
• (d) is subject to standard delivery scheduling, site access and safe unloading conditions being met.

2.4 Deliveries to sites beyond 60km may still be arranged and will be charged at earth gear’s standard delivery rates, or a partial/discounted rate at earth gear’s discretion. Ask your local branch for a quote.

2.5 The Free Delivery Offer cannot be redeemed for cash and has no cash value.

3. Weekly Rate Offers

3.1 In addition to, or instead of, the Free Delivery Offer, earth gear may from time to time offer promotional rates during the Campaign Period, which may include (without limitation):

• (a) multi-week hire rates (for example, an extended-hire rate on longer bookings);
• (b) promotional / clearance rates on nominated equipment categories; and/or
• (c) paired-hire rates where a nominated machine is hired alongside another item of equipment.

3.2 The availability, amount and eligibility criteria of any rate offer are determined by earth gear each week and are subject to fleet availability. Promotional rates apply only to bookings confirmed during the relevant offer week and only to the specific equipment nominated by earth gear.

3.3 Unless expressly stated otherwise, promotional offers cannot be combined with any other discount, promotion, negotiated rate, account rate or offer.

4. Eligibility & Bookings

4.1 Offers are available to new and existing earth gear customers who meet earth gear’s standard hire requirements, including account approval, identification, and acceptance of the standard Hire Agreement.

4.2 To qualify, a booking must be confirmed with earth gear during the relevant offer week and the equipment collected or delivered within the dates agreed at the time of booking.

4.3 A booking is only “confirmed” once earth gear has accepted it and the Hirer has completed all required booking steps (including any deposit, documentation and agreement to the standard Hire Agreement).

4.4 All hires remain subject to earth gear’s standard credit, deposit, bond, insurance/damage waiver, minimum-hire-period and site-suitability requirements.

5. Delivery & Breakdown Promises

5.1 1-Hour Delivery Promise. Where advertised, earth gear aims to have eligible, in-stock equipment on site within one (1) hour of a confirmed booking. This promise applies subject to fair-use conditions, including that:

• (a) the delivery site is within the servicing branch’s standard delivery area;
• (b) the request is made during earth gear’s normal operating hours;
• (c) suitable equipment is in stock and ready at the branch at the time of the request;
• (d) safe and lawful site access is available for delivery; and
• (e) delivery is not prevented or delayed by factors outside earth gear’s reasonable control (including traffic, weather, road conditions, site access, or other events beyond our control).

5.2 4-Hour Breakdown Promise. Where advertised, earth gear aims to respond to a genuine mechanical breakdown of hired equipment within four (4) hours, subject to the same fair-use conditions in clause 5.1 and provided the breakdown is not caused by misuse, operator error, damage, or failure to operate and maintain the equipment in accordance with the Hire Agreement and manufacturer instructions.

5.3 The promises in this clause 5 are service commitments and, except as required by law (including the Australian Consumer Law), do not create a right to compensation where a target response time is not met due to the conditions above.

6. Machine Condition & Use

6.1 All equipment is supplied serviced and in safe working order and remains subject to the inspection, operation, maintenance and return-condition obligations set out in the standard Hire Agreement.

6.2 The Hirer is responsible for ensuring operators are appropriately licensed, competent and authorised, and that equipment is used only for its intended purpose and within its rated limits.

7. Pricing, GST & Payment

7.1 Unless stated otherwise, advertised rates are exclusive of GST. GST and any applicable surcharges, bond, damage waiver, fuel, cleaning, environmental or other charges are additional and payable in accordance with the standard Hire Agreement.

7.2 Advertised savings (e.g. “book 3 weeks, pay for 2.5”) are calculated against earth gear’s standard published hire rate for the relevant equipment at the time of the offer.

7.3 All payments are due in accordance with earth gear’s standard payment and credit terms.

8. Australian Consumer Law

8.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded (“Non-Excludable Rights”).

8.2 To the maximum extent permitted by law, and other than in respect of Non-Excludable Rights, earth gear’s liability in connection with any promotional offer is limited to re-supplying the relevant service or paying the cost of having it re-supplied.

9. General

9.1 earth gear reserves the right to refuse or cancel any booking, or to disqualify any person, where it reasonably suspects fraud, misuse of an offer, or breach of these Terms.

9.2 These Terms are governed by the laws of the State of Queensland, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that State.

9.3 If any part of these Terms is found to be invalid or unenforceable, that part is severed and the remaining Terms continue in full force.
